Welcome to Nikole With a K! These Terms and Conditions ("Terms") govern your use of my website, https://www.shinewithnikole.com (the "Site"), and all services, programs, content, and products offered by me, Nikole Fernandez Rivera (the "Coach," "I," "me," or "my"), including but not limited to coaching sessions, workshops, courses, and digital products (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use the Services.

1. Coaching and Human Design Disclaimer

My role as an empowerment coach and human design teacher is to support and guide you in achieving your own goals. The information provided through my Services is for informational and educational purposes only and is not a substitute for professional medical, psychological, financial, or legal advice.

You acknowledge that you are solely responsible for your own well-being, decisions, and actions. The Coach does not guarantee any specific results. You agree to take full responsibility for any and all consequences of your participation in the Services.

2. Intellectual Property

All content on this Site and within the Services, including text, graphics, logos, images, audio, video, and digital downloads, is the property of Nikole With a K or its content suppliers and is protected by intellectual property laws.

You agree not to:

• Reproduce, duplicate, copy, sell, or exploit any portion of the Services without my express written permission.

• Use any of the content for commercial purposes.

• Modify, adapt, or hack the Site or Services.

3. Client Responsibilities

As a client, you agree to:

• Be on time for all scheduled appointments.

• Come to sessions prepared to engage and participate fully.

• Be open and honest in your communication.

• Respect the confidentiality of other participants if you are in a group program.

4. Payment and Refund Policy

Payment

All payments for Services must be made in full before the service is rendered unless a payment plan has been agreed upon in writing. I accept payment via the methods specified on the Site.

Refunds

All sales of Services are final. I do not offer refunds once a purchase has been made, whether for one-on-one coaching, group programs, or digital products. Please be sure of your decision before making a purchase. In extenuating circumstances, I may offer a credit for future services at my sole discretion.

5. Cancellation and Rescheduling Policy

One-on-One Coaching

If you need to cancel or reschedule a one-on-one coaching session, you must notify me at least 24 hours in advance. If you cancel with less than 24 hours' notice, or if you do not show up for your scheduled session, you will be charged for the full session.

Group Programs and Workshops

Group programs and workshops are non-refundable and cannot be rescheduled. By signing up, you commit to attending the scheduled sessions.

6. Confidentiality

I will maintain the confidentiality of our coaching relationship. The information you share with me in one-on-one sessions will not be shared with anyone else without your written consent, except where required by law (e.g., if there is a risk of harm to yourself or others).

Please note that confidentiality cannot be guaranteed in a group setting. While I ask all participants to respect one another's privacy, you acknowledge that I am not responsible for the actions of other group members.

7. Termination of Services

I reserve the right to refuse or terminate services at any time, for any reason, without notice. If I terminate services due to a violation of these Terms, you will not be entitled to a refund.

8. Limitation of Liability

Under no circumstances shall Nikole With a K or Nikole Fernandez Rivera be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Services or your reliance on any information provided therein.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Virginia, without regard to its conflict of law provisions.

10. Changes to Terms

I reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site and Services after any changes indicates your acceptance of the new Terms.
